I: RIGHTS AND DUTIES</h2><!--Section: section/30, type: title-->\n<div id=\"section/30\" class=\"section\">\n<h3>CHAPTER I: RIGHTS AND FREEDOMS</h3><!--Section: section/31, type: title-->\n<div id=\"section/31\" class=\"section\" Every individual has the right to life, liberty, security and integrity of person.</p>\n</div>\n</div><!--Section: section/35, type: title-->\n<div id=\"section/35\" class=\"section\" data-topics=\"http://www.constituteproject.org/ontology/childpro\">\n<p>Article 3:</p><!--Section: section/36, type: body-->\n<div id=\"section/36\" class=\"section\">\n<p class=\"content\">The State ensures the protection of children against human trafficking and related offenses and against recruitment into violent extremist groups.</p>\n</div>\n</div><!--Section: section/37, type: title-->\n<div id=\"section/37\" class=\"section\">\n<p>Article 4:</p><!--Section: section/38, type: body-->\n<div id=\"section/38\" class=\"section\" data-topics=\"http://www.constituteproject.org/ontology/torture,http://www.constituteproject.org/ontology/slave,http://www.constituteproject.org/ontology/cruelty\">\n<p class=\"content\">No one may be subjected to torture, slavery, inhuman, cruel and degrading treatment.</p>\n</div><!--Section: section/39, type: body-->\n<div id=\"section/39\" class=\"section\">\n<p class=\"content\">Any individual, any agent of the State who is guilty of such acts, either on their own initiative or upon instruction, shall be punished in accordance with the law.</p>\n</div>\n</div><!--Section: section/40, type: title-->\n<div id=\"section/40\" class=\"section\">\n<p>Article 5:</p><!--Section: section/41, type: body-->\n<div id=\"section/41\" class=\"section\">\n<p class=\"content\">No one may be forced into exile.</p>\n</div><!--Section: section/42, type: body-->\n<div id=\"section/42\" class=\"section\" data-topics=\"http://www.constituteproject.org/ontology/asylum\">\n<p class=\"content\">Any person persecuted by reason of their political or religious convictions, or their ethnic affiliation, may benefit from the right of asylum in the Republic of Mali.</p>\n</div>\n</div><!--Section: section/43, type: title-->\n<div id=\"section/43\" class=\"section\">\n<p>Article 6:</p><!--Section: section/44, type: body-->\n<div id=\"section/44\" class=\"section\">\n<p class=\"content\">Any person subject to a measure depriving them of liberty has the right to be examined by a doctor of their choice.</p>\n</div><!--Section: section/45, type: body-->\n<div id=\"section/45\" class=\"section\" data-topics=\"http://www.constituteproject.org/ontology/habcorp\">\n<p class=\"content\">No one may be detained for a period exceeding forty-eight (48) hours except by reasoned decision of a magistrate of the judicial order.</p>\n</div><!--Section: section/46, type: body-->\n<div id=\"section/46\" class=\"section\" data-topics=\"http://www.constituteproject.org/ontology/habcorp\">\n<p class=\"content\">No one may be detained in a penitentiary establishment except on a warrant issued by a magistrate of the judicial order.</p>\n</div>\n</div><!--Section: section/47, type: title-->\n<div id=\"section/47\" class=\"section\">\n<p>Article 7:</p><!--Section: section/48, type: body-->\n<div id=\"section/48\" class=\"section\" data-topics=\"http://www.constituteproject.org/ontology/fairtri,http://www.constituteproject.org/ontology/speedtri\">\n<p class=\"content\">Every person has the right to a fair trial and to a judgment rendered within a reasonable time.</p>\n</div><!--Section: section/49, type: body-->\n<div id=\"section/49\" class=\"section\" data-topics=\"http://www.constituteproject.org/ontology/couns\">\n<p class=\"content\">The right to defense, including that of being assisted by the lawyer of one's choice, is guaranteed from the preliminary investigation.</p>\n</div><!--Section: section/50, type: body-->\n<div id=\"section/50\" class=\"section\" data-topics=\"http://www.constituteproject.org/ontology/presinoc\">\n<p class=\"content\">Every accused person is presumed innocent until their guilt is established by the competent court.</p>\n</div><!--Section: section/51, type: body-->\n<div id=\"section/51\" class=\"section\" data-topics=\"http://www.constituteproject.org/ontology/expost,http://www.constituteproject.org/ontology/wolaw\">\n<p class=\"content\">Punishment is personal. Public education is compulsory, free and secular. Private education is recognized and is exercised under the conditions defined by law.</p>\n</div>\n</div><!--Section: section/61, type: title-->\n<div id=\"section/61\" class=\"section\" data-topics=\"http://www.constituteproject.org/ontology/privacy\">\n<p>Article 12:</p><!--Section: section/62, type: body-->\n<div id=\"section/62\" class=\"section\">\n<p class=\"content\">The home, private domain, private and family life, personal data, secrecy of correspondence and communications are inviolable. section/86, type: body-->\n<div id=\"section/86\" class=\"section\">\n<p class=\"content\">Every citizen, every person living in Malian territory has the duty to respect, in all circumstances, the id=\"section/93\" class=\"section\">\n<p class=\"content\">In case of established calamity, all citizens have the duty to provide their assistance under the conditions defined by class=\"section\">\n<p class=\"content\">Every citizen invested with a public mandate or charged with public employment or a public service mission has the duty to fulfill it with conscience, loyalty class=\"section\">\n<p>Article 30:</p><!--Section: section/103, type: body-->\n<div id=\"section/103\" class=\"section\" data-topics=\"http://www.constituteproject.org/ontology/system\">\n<p class=\"content\">Mali is an independent, sovereign, unitary, indivisible, democratic, secular and social Republic.</p>\n</div><!--Section: section/104, type: body-->\n<div id=\"section/104\" section/174, type: body-->\n<div id=\"section/174\" class=\"section\">\n<p class=\"content\">The law completes the provisions relating to the election of the President of the State. Parliament. It is only admissible if it is signed by at least two-thirds (2/3) of the members.</p>\n</div><!--Section: section/252, type: body-->\n<div id=\"section/252\" class=\"section\">\n<p class=\"content\">The concerned Chamber refers the matter to the competent commission which proceeds with all investigations and hearings necessary at the end of which it assesses whether or not there are grounds to pursue the procedure.</p>\n</div><!--Section: section/253, type: body-->\n<div id=\"section/253\" class=\"section\">\n<p class=\"content\">If the commission decides that there are no grounds to pursue, the impeachment procedure is terminated.</p>\n</div><!--Section: section/254, type: body-->\n<div id=\"section/254\" class=\"section\">\n<p class=\"content\">If the commission decides that there are grounds to pursue, it draws up the reasoned act of accusation which is submitted to the vote of the Chamber by simple majority of the members.</p>\n</div><!--Section: section/255, type: body-->\n<div id=\"section/255\" class=\"section\">\n<p class=\"content\">In case of adoption of the act of accusation, the other Chamber is referred to within eight (08) days and must rule in identical terms within fifteen (15) days. They enter into force upon their adoption, but become null and void if the ratification bill is not submitted to Parliament before the date set by the enabling law. Upon expiration of the period mentioned in the first paragraph of this article, ordinances may only be modified by law in matters that are within the legislative domain.</p>\n</div>\n</div><!--Section: section/416, type: title-->\n<div id=\"section/416\" class=\"section\">\n<p>Article 122:</p><!--Section: section/417, type: body-->\n<div id=\"section/417\" class=\"section\" data-topics=\"http://www.constituteproject.org/ontology/legapp,http://www.constituteproject.org/ontology/finance\">\n<p class=\"content\">If the Government so requests, the Chamber seized shall rule by a single vote on all or part of the text under discussion, retaining only the amendments proposed or accepted by the Government. Proposals and amendments formulated by members of Parliament are not admissible when their adoption would result in either a reduction of public resources or the creation or aggravation of a public burden, unless such proposals or amendments are accompanied by a proposal for equivalent revenues or savings.</p>\n</div><!--Section: section/418, type: body-->\n<div id=\"section/418\" class=\"section\" data-topics=\"http://www.constituteproject.org/ontology/uncon\">\n<p class=\"content\">If it appears, during the legislative procedure, that a proposal or amendment is not within the domain of law, the Government may raise inadmissibility. In case of disagreement between the Government and the Chamber seized, the Constitutional Court, at the request of the Government or the President of the Chamber concerned, shall rule within eight (08) days.</p>\n</div>\n</div><!--Section: section/419, type: title-->\n<div id=\"section/419\" class=\"section\" data-topics=\"http://www.constituteproject.org/ontology/divhouse\">\n<p>Article 123:</p><!--Section: section/420, type: body-->\n<div id=\"section/420\" class=\"section\">\n<p class=\"content\">Every bill or proposed law is examined successively by the two (02) Chambers of Parliament with a view to adopting an identical text.</p>\n</div><!--Section: section/421, type: body-->\n<div id=\"section/421\" class=\"section\">\n<p class=\"content\">Discussion of bills takes place, before the first Chamber seized, on the text presented by the Government.</p>\n</div><!--Section: section/422, type: body-->\n<div id=\"section/422\" class=\"section\">\n<p class=\"content\">A Chamber seized of a text voted by the other chamber deliberates on the text transmitted to it.</p>\n</div><!--Section: section/423, type: body-->\n<div id=\"section/423\" class=\"section\">\n<p class=\"content\">When, as a result of disagreement between the two (02) chambers, a bill or proposed law could not be adopted after two (02) readings by the two (02) Chambers, or if the Government has declared urgency, after a single reading by each of them, the Prime Minister has the power to convene a joint committee charged with proposing an identical text on the remaining provisions.</p>\n</div><!--Section: section/424, type: body-->\n<div id=\"section/424\" class=\"section\">\n<p class=\"content\">The text prepared by the joint committee may be submitted by the Government for approval to both (02) chambers. No amendment to this text is admissible, except with the agreement of the Government.</p>\n</div><!--Section: section/425, type: body-->\n<div id=\"section/425\" class=\"section\">\n<p class=\"content\">If the joint committee fails to adopt a common text or if this text is not adopted under the conditions provided for in the preceding paragraph, the Government may, after a new reading by the National Assembly and the Senate, request the National Assembly to rule definitively.</p>\n</div><!--Section: section/426, type: body-->\n<div id=\"section/426\" class=\"section\">\n<p class=\"content\">In this case, the National Assembly may adopt either the text prepared by the joint committee, or the text voted by it, modified, where appropriate, by one or more of the amendments adopted by the Senate.</p>\n</div>\n</div><!--Section: section/427, type: title-->\n<div id=\"section/427\" class=\"section\" data-topics=\"http://www.constituteproject.org/ontology/orglaw\">\n<p>Article 124:</p><!--Section: section/428, type: body-->\n<div id=\"section/428\" class=\"section\">\n<p class=\"content\">Laws to which this Constitution confers the character of organic law are voted under the following conditions:</p><!--Section: section/6d015996-e2a5-47f0-bd88-52d984fd82cf, type: list-->\n<ul><li id=\"section/6d015996-e2a5-47f0-bd88-52d984fd82cf\" style=\"list-style-type: '&bull; '\">\n<p class=\"content\">the bill or proposal may not, on first reading, be submitted for deliberation and vote by the Chambers of Parliament until the expiration of a period of fifteen (15) days after its filing;</p>\n</li><!--Section: section/1d404cf6-1678-4a89-b2ed-1f8a2e2f4b0c, type: list-->\n<li id=\"section/1d404cf6-1678-4a89-b2ed-1f8a2e2f4b0c\" style=\"list-style-type: '&bull; '\">\n<p class=\"content\">the procedure of article 123 is applicable;</p>\n</li><!--Section: section/55ea4914-825f-4203-a5e5-98c84ba06fdf, type: list-->\n<li id=\"section/55ea4914-825f-4203-a5e5-98c84ba06fdf\" style=\"list-style-type: '&bull; '\">\n<p class=\"content\">it is adopted by absolute majority of the members of each Chamber.</p>\n</li></ul></div><!--Section: section/430, type: body-->\n<div id=\"section/430\" class=\"section\">\n<p class=\"content\">However, in the absence of agreement between the two (02) Chambers, the text is adopted on final reading by the National Assembly by absolute majority of its members.</p>\n</div><!--Section: section/431, type: body-->\n<div id=\"section/431\" class=\"section\" data-topics=\"http://www.constituteproject.org/ontology/uncon\">\n<p class=\"content\">Organic laws may only be promulgated after declaration by the Constitutional Court of their conformity to the Constitution.</p>\n</div>\n</div><!--Section: section/432, type: title-->\n<div id=\"section/432\" class=\"section\" data-topics=\"http://www.constituteproject.org/ontology/finance\">\n<p>Article 125:</p><!--Section: section/433, type: body-->\n<div id=\"section/433\" class=\"section\">\n<p class=\"content\">Parliament is seized of the finance bill upon the opening of the ordinary session preceding the budgetary period.</p>\n</div><!--Section: section/434, type: body-->\n<div id=\"section/434\" class=\"section\">\n<p class=\"content\">If the National Assembly has not ruled at first reading, within forty (40) days after the filing of the finance bill, the Government refers the matter to the Senate which must rule within fifteen (15) days. The procedure provided for in article 123<strong>.</strong> shall apply.</p>\n</div><!--Section: section/435, type: body-->\n<div id=\"section/435\" class=\"section\">\n<p class=\"content\">If Parliament has not ruled within seventy (70) days, the budget is then established ex officio by the Government based on the revenues of the previous fiscal year and after opinion of the Court of Accounts.</p>\n</div>\n</div><!--Section: section/436, type: title-->\n<div id=\"section/436\" class=\"section\">\n<p>Article 126:</p><!--Section: section/437, type: body-->\n<div id=\"section/437\" class=\"section\" data-topics=\"http://www.constituteproject.org/ontology/invexe\">\n<p class=\"content\">Before either Chamber of Parliament, the Prime Minister may, on his own initiative or at the request of the President of one of the Chambers, make a statement on a specific subject which gives rise to a debate without vote.</p>\n</div>\n</div><!--Section: section/438, type: title-->\n<div id=\"section/438\" class=\"section\" data-topics=\"http://www.constituteproject.org/ontology/invexe\">\n<p>Article 127:</p><!--Section: section/439, type: body-->\n<div id=\"section/439\" class=\"section\">\n<p class=\"content\">Parliament controls the action of the Government.</p>\n</div><!--Section: section/440, type: body-->\n<div id=\"section/440\" class=\"section\">\n<p class=\"content\">Members of Parliament may pose written questions to ministers who are required to respond within fifteen (15) days following the date of their receipt. The questions and responses are published in the Official Journal.</p>\n</div><!--Section: section/441, type: body-->\n<div id=\"section/441\" class=\"section\">\n<p class=\"content\">Members of Parliament may pose oral questions and current affairs questions to ministers according to the procedures determined by the internal rules of each Chamber.</p>\n</div>\n</div><!--Section: section/442, type: title-->\n<div id=\"section/442\" class=\"section\" data-topics=\"http://www.constituteproject.org/ontology/invexe\">\n<p>Article 128:</p><!--Section: section/443, type: body-->\n<div id=\"section/443\" class=\"section\">\n<p class=\"content\">Each Chamber of Parliament may designate, within itself, committees of inquiry whose powers and procedures for organization and operation are established by its internal rules.</p>\n</div><!--Section: section/444, type: body-->\n<div id=\"section/444\" class=\"section\">\n<p class=\"content\">However, no commission of inquiry may be created when the facts have given rise to judicial proceedings and as long as such proceedings are ongoing. If a commission has already been created, its mission ends as soon as a judicial investigation is opened relating to the facts that motivated its creation.</p>\n</div>\n</div>\n</div>\n</div><!--Section: section/445, type: title-->\n<div id=\"section/445\" class=\"section\">\n<h2>TITLE V: OF THE JUDICIAL POWER</h2><!--Section: section/446, type: title-->\n<div id=\"section/446\" class=\"section\">\n<h3>CHAPTER I: GENERAL PROVISIONS</h3><!--Section: section/447, type: title-->\n<div id=\"section/447\" class=\"section\">\n<p>Article 129:</p><!--Section: section/448, type: body-->\n<div id=\"section/448\" class=\"section\" data-topics=\"http://www.constituteproject.org/ontology/judind,http://www.constituteproject.org/ontology/levjud\">\n<p class=\"content\">The judicial power is independent of the executive and legislative powers.
