OF FUNDAMENTAL PRINCIPLES AND RIGHTS</h2><!--Section: section/7, type: title-->\n<div id=\"section/7\" class=\"section\" data-topics=\"http://www.constituteproject.org/ontology/inalrght\">\n<h3>Article 1</h3><!--Section: section/8, type: body-->\n<div id=\"section/8\" class=\"section\">\n<p class=\"content\">The Gabonese Republic recognizes and guarantees the inalienable and imprescriptible human rights, which are necessarily tied to the public powers:</p><!--Section: section/9, type: list-->\n<ol><li id=\"section/9\" style=\"list-style-type: '1&deg; '\">\n<p class=\"content\">Each citizen has the right to the free development of his or her personality, while respecting the rights of others and the public order. No one may be humiliated, mistreated or tortured, even during moments of arrest or imprisonment;</p>\n</li><!--Section: section/11, type: list-->\n<li id=\"section/11\" style=\"list-style-type: '2&deg; '\">\n<p class=\"content\">The liberty of consciousness, thought, opinion, expression, communication, and the free practice of religion, are guaranteed to all, limited only by a respect for the public order;</p>\n</li><!--Section: section/13, type: list-->\n<li id=\"section/13\" style=\"list-style-type: '3&deg; '\">\n<p class=\"content\">The liberty to come and go within the territory of the Gabonese Republic and to leave and return is guaranteed to all Gabonese citizens, limited only by a respect for the public order;</p>\n</li><!--Section: section/15, type: list-->\n<li id=\"section/15\" style=\"list-style-type: '4&deg; '\">\n<p class=\"content\">The rights to defense, in the case of a trial, are guaranteed to all. Preventative detention must not exceed the time period provisioned by the law;</p>\n</li><!--Section: section/17, type: list-->\n<li id=\"section/17\" style=\"list-style-type: '5&deg; '\">\n<p class=\"content\">The privacy of correspondence, of postal, telegraphic, telephonic and telematics communications is inalienable. A restriction on this right to privacy may not be ordered except through an application of the law, in the interest of the public order and national security;</p>\n</li><!--Section: section/19, type: list-->\n<li id=\"section/19\" style=\"list-style-type: '6&deg; '\">\n<p class=\"content\">Limits to the use of computing technology may be fixed by the law in the interest of preserving personhood, one\u2019s personal and familial intimacy, and the full exercise of one\u2019s rights;</p>\n</li><!--Section: section/21, type: list-->\n<li id=\"section/21\" style=\"list-style-type: '7&deg; '\">\n<p class=\"content\">Each citizen has the duty to work and the right to obtain employment. None may be discriminated against in one\u2019s work because of his or her origins, sex, race or opinions;</p>\n</li><!--Section: section/23, type: list-->\n<li id=\"section/23\" style=\"list-style-type: '8&deg; '\">\n<p class=\"content\">The State, according to its means, guarantees to all, notably to children, mothers, the handicapped, aged workers and the elderly the protection of health, social security, a preserved natural environment, rest and leisure;</p>\n</li><!--Section: section/25, type: list-->\n<li id=\"section/25\" style=\"list-style-type: '9&deg; '\">\n<p class=\"content\">All Gabonese citizens residing temporarily or permanently abroad benefit from the protection and assistance of the state, according to conditions fixed by national law or international accord;</p>\n</li><!--Section: section/27, type: list-->\n<li id=\"section/27\" style=\"list-style-type: '10&deg; '\">\n<p class=\"content\">All people, as individuals or as groups, have the right to own property. None may be deprived of one\u2019s property, if not for a public necessity, legally declared, required and under conditions of a just and prior compensation. Notwithstanding, the dispossession of abandoned buildings justified by public utility and or an insufficiency of development is regulated by the law;</p>\n</li><!--Section: section/29, type: list-->\n<li id=\"section/29\" style=\"list-style-type: '11&deg; '\">\n<p class=\"content\">All Gabonese have the right to freely fix his or her domicile or residence in any part of the national territory and to there exercise all activities, respecting the public order and the law;</p>\n</li><!--Section: section/31, type: list-->\n<li id=\"section/31\" style=\"list-style-type: '12&deg; '\">\n<p class=\"content\">The domicile is inalienable. A search of the home may only be ordered by a judge or by the other authorities designated by the law. Searches must be executed within the law\u2019s prescriptions. Measures that may threaten or restrict the inalienability of the domicile may only be taken to address community dangers or to protect the public order against imminent menaces, notably epidemic risks or persons in immediate danger;</p>\n</li><!--Section: section/33, type: list-->\n<li id=\"section/33\" style=\"list-style-type: '13&deg; '\">\n<p class=\"content\">The right to form associations, political parties or groups, syndicates, companies, establishments of social interest as well as religious communities is guaranteed to all within the conditions fixed by the law; religious communities independently regulate themselves and their affairs, respecting the principles of national sovereignty, the public order and the preservation of the moral and mental integrity of the individual. Any associations, political parties or groups, syndicates, companies, establishments of social interest or religious communities performing activities contrary to the law, morality, or the goodwill of ethnic groups or communities may be prohibited according to the terms of the law.</p><!--Section: section/35, type: body-->\n<div id=\"section/35\" class=\"section\" data-topics=\"http://www.constituteproject.org/ontology/equalgr4,http://www.constituteproject.org/ontology/equalgr6\">\n<p class=\"content\">All discriminatory acts based on race, ethnicity, or religion, including all regionalist propaganda threatening interior or exterior national security or the integrity of the State is punishable by the law;</p>\n</div>\n</li><!--Section: section/36, type: list-->\n<li id=\"section/36\" style=\"list-style-type: '14&deg; '\">\n<p class=\"content\">The family is the natural cellular base of society, and marriage is its legitimate structure. They have particular protection from the State;</p>\n</li><!--Section: section/38, type: list-->\n<li id=\"section/38\" style=\"list-style-type: '15&deg; '\">\n<p class=\"content\">The state has the responsibility of organizing a general population census every ten years;</p>\n</li><!--Section: section/40, type: list-->\n<li id=\"section/40\" style=\"list-style-type: '16&deg; '\">\n<p class=\"content\">The care given to children and their education constitute a natural right for parents and a responsibility that they exercise under the surveillance and with the aide of the State and its public collectivities. Parents have the right, under the laws of obligatory education, to choose the moral and religious education of their children. In the eyes of the State, all children have the same rights regarding assistance to their physical, intellectual, and moral development;</p>\n</li><!--Section: section/42, type: list-->\n<li id=\"section/42\" style=\"list-style-type: '17&deg; '\">\n<p class=\"content\">The protection of the country\u2019s youth from exploitation and moral, intellectual and physical abandonment, is an obligation of the State and the public collectivities;</p>\n</li><!--Section: section/44, type: list-->\n<li id=\"section/44\" style=\"list-style-type: '18&deg; '\">\n<p class=\"content\">The State guarantees equal access to instruction, professional development and culture for children and adults;</p>\n</li><!--Section: section/46, type: list-->\n<li id=\"section/46\" style=\"list-style-type: '19&deg; '\">\n<p class=\"content\">It is the State\u2019s responsibility to organize public education based on religious neutrality and, according to its means, provide it freely to the public; the awarding of diploma rests a right of the state;</p><!--Section: section/48, type: body-->\n<div id=\"section/48\" class=\"section\">\n<p class=\"content\">Nevertheless, the freedom to educate is guaranteed to all. All persons may open a kindergarten, primary, secondary, or superior school, or a university, according to the conditions fixed by the law.</p>\n</div><!--Section: section/49, type: body-->\n<div id=\"section/49\" class=\"section\">\n<p class=\"content\">The law determines the conditions in which the State and the public collectivities may participate in the financial needs of private educational institutions, recognized for their public utility.</p>\n</div><!--Section: section/50, type: body-->\n<div id=\"section/50\" class=\"section\">\n<p class=\"content\">In public educational institutions, religious instruction may be dispensed to students at the demand of their parents, in the conditions determined by the relevant regulations.</p>\n</div><!--Section: section/51, type: body-->\n<div id=\"section/51\" class=\"section\">\n<p class=\"content\">The law fixes the conditions of function of private educational establishments based upon their specialties;</p>\n</div>\n</li><!--Section: section/52, type: list-->\n<li id=\"section/52\" style=\"list-style-type: '20&deg; '\">\n<p class=\"content\">The Nation proclaims the solidarity and equality of all before its public financial obligations. All must participate, in proportion of their resources, in the funding of public expenses. The Nations proclaim additionally the solidarity of all before expenses or debt that result from natural and national calamities.</p>\n</li><!--Section: section/54, type: list-->\n<li id=\"section/54\" style=\"list-style-type: '21&deg; '\">\n<p class=\"content\">Each citizen is obligated to defend their homeland, and to protect and respect the Constitution, the laws and the regulations of the Republic;</p>\n</li><!--Section: section/56, type: list-->\n<li id=\"section/56\" style=\"list-style-type: '22&deg; '\">\n<p class=\"content\">The defense of the Nation and the maintenance of public order are essentially assured by the forces of defense and national security.</p><!--Section: section/58, type: body-->\n<div id=\"section/58\" class=\"section\">\n<p class=\"content\">Consequentially, neither person, nor group of people may constitute themselves as a private militia or para-military group; the forces of defense and national security are at the service of the State.</p>\n</div><!--Section: section/59, type: body-->\n<div id=\"section/59\" class=\"section\">\n<p class=\"content\">In times of peace, the armed forces of Gabon may participate in the economic and social development of the Nation;</p>\n</div>\n</li><!--Section: section/60, type: list-->\n<li id=\"section/60\" style=\"list-style-type: '23&deg; '\">\n<p class=\"content\">No one may be arbitrarily detained; if deemed appropriate by the necessities of security and procedure, no one may be kept in police custody or temporary imprisonment if he or she presents sufficient guarantees of legal representation.</p><!--Section: section/62, type: body-->\n<div id=\"section/62\" class=\"section\" data-topics=\"http://www.constituteproject.org/ontology/couns,http://www.constituteproject.org/ontology/presinoc\">\n<p class=\"content\">All defendants are to be presumed innocent until proven guilty, following a trial with the standard guarantees for their defense.</p>\n</div><!--Section: section/63, type: body-->\n<div id=\"section/63\" class=\"section\" data-topics=\"http://www.constituteproject.org/ontology/speedtri\">\n<p class=\"content\">The judicial power, guardian of individual liberty, assures the respect of these principles in the time periods fixed by the law.</p>\n</div>\n</li></ol></div>\n</div>\n</div><!--Section: section/64, type: title-->\n<div id=\"section/64\" class=\"section\">\n<h2>FIRST TITLE. OF THE REPUBLIC AND ITS SOVERIEGNTY</h2><!--Section: section/65, type: title-->\n<div id=\"section/65\" class=\"section\">\n<h3>Article 2</h3><!--Section: section/66, type: body-->\n<div id=\"section/66\" class=\"section\" data-topics=\"http://www.constituteproject.org/ontology/system,http://www.constituteproject.org/ontology/seprel\">\n<p class=\"content\">Gabon is an indivisible, secular, democratic and social Republic. Only their descendants, having resided in Gabon without discontinuity, may present themselves beginning with the fourth generation of descendants.</p>\n</div><!--Section: section/104, type: body-->\n<div id=\"section/104\" class=\"section\">\n<p class=\"content\">If before the vote, the Constitutional Court, called upon according to the conditions previsioned by the law, affirms the death or hindering circumstance of one of the candidates, the Court will pronounce a postponement of the elections.</p>\n</div><!--Section: section/105, type: body-->\n<div id=\"section/105\" class=\"section\">\n<p class=\"content\">The Constitutional Court may extend the provisioned time periods conforming to Article 11 below, but the elections may not take place more than thirty-five (35) days after the date of the decision of the Constitutional Court.</p>\n</div><!--Section: section/106, type: body-->\n<div id=\"section/106\" class=\"section\">\n<p class=\"content\">If an application of the policies in the present paragraphs postpones the election to a date beyond the last day in office of the current President, he or she will remain in office until the election of the successor.</p>\n</div><!--Section: section/107, type: body-->\n<div id=\"section/107\" class=\"section\">\n<p class=\"content\">The ways and means by which the present article may be applied are fixed by organic law.</p>\n</div>\n</div><!--Section: section/108, type: title-->\n<div id=\"section/108\" class=\"section\">\n<p>Article 11</p><!--Section: section/109, type: body-->\n<div id=\"section/109\" class=\"section\">\n<p class=\"content\">The presidential term begins on the day he presents himself for the presidential oath and finishes at the end of the seventh year following his election.</p>\n</div><!--Section: section/110, type: body-->\n<div id=\"section/110\" class=\"section\" data-topics=\"http://www.constituteproject.org/ontology/electsch\">\n<p class=\"content\">The election of the President of the Republic takes place at least a month and at most two months before the end of the previous president\u2019s term.</p>\n</div><!--Section: section/111, type: body-->\n<div id=\"section/111\" class=\"section\">\n<p class=\"content\">A current President may not shorten his or her term in any manner to run for another term.</p>\n</div><!--Section: section/112, type: body-->\n<div id=\"section/112\" class=\"section\" data-topics=\"http://www.constituteproject.org/ontology/hosdec,http://www.constituteproject.org/ontology/exsess\">\n<p class=\"content\">If the current President of the Republic runs for the next presidential term, the National Assembly may not be dissolved. The President may also not exercise his power to legislate by ordinance from the moment he announces his candidacy up to the election. In cases of necessity, Parliament may convene in an extraordinary session.</p>\n</div>\n</div><!--Section: section/113, type: title-->\n<div id=\"section/113\" class=\"section\">\n<p>Article 11a</p><!--Section: section/114, type: body-->\n<div id=\"section/114\" class=\"section\">\n<p class=\"content\">The presidential oath marks the beginning of the presidential term. It may not take place before the Constitutional Court\u2019s decision to proclaim the official election results.</p>\n</div><!--Section: section/115, type: body-->\n<div id=\"section/115\" class=\"section\">\n<p class=\"content\">If there is no dispute of the results, the Constitutional Court\u2019s decision will take place on the eighth (8th) day following the announcement of the results by the relevant administrative authority.</p>\n</div><!--Section: section/116, type: body-->\n<div id=\"section/116\" class=\"section\">\n<p class=\"content\">If there is a dispute, the Court\u2019s decision must take place within a maximum delay of fifteen (15) days from the eighth (8th) day following the announcement of election results.</p>\n</div><!--Section: section/117, type: body-->\n<div id=\"section/117\" class=\"section\">\n<p class=\"content\">If the death or permanent impairment of the current President who was not re-elected in the most recent presidential elections takes place before the end of his or her term, the President-elect will immediately take the oath of office. By this title, questions regarding security and defense fall under his direct authority.</p>\n</div><!--Section: section/171, type: body-->\n<div id=\"section/171\" class=\"section\" data-topics=\"http://www.constituteproject.org/ontology/hosstaff\">\n<p class=\"content\">The President of the Republic presides over the Superior Council of National Defense and Public Security, and the committees of defense and security.</p>\n</div><!--Section: section/172, type: body-->\n<div id=\"section/172\" class=\"section\">\n<p class=\"content\">The Prime Minister may stand in for the President by express authorization and for a determined agenda.</p>\n</div><!--Section: section/173, type: body-->\n<div id=\"section/173\" class=\"section\">\n<p class=\"content\">The Ministers in charge of defense and security assure the direction of the committees on military and civil defense according to their areas of competence. A law establishes the means by which the present article may be applied.</p>\n</div>\n</div><!--Section: section/174, type: title-->\n<div id=\"section/174\" class=\"section\" data-topics=\"http://www.constituteproject.org/ontology/pardon\">\n<p>Article 23</p><!--Section: section/175, type: body-->\n<div id=\"section/175\" class=\"section\">\n<p class=\"content\">The President of the Republic has the right to pardon.</p>\n</div>\n</div><!--Section: section/176, type: title-->\n<div id=\"section/176\" class=\"section\" data-topics=\"http://www.constituteproject.org/ontology/exsess\">\n<p>Article 24</p><!--Section: section/177, type: body-->\n<div id=\"section/177\" class=\"section\">\n<p class=\"content\">The President communicates with each Chamber of Parliament through messages to be read by their presidents. He or she assures the execution of the laws. According to the conditions of Article 20 mentioned above, the Prime Minister exercises regulatory power and nominates civil and military posts of the State. The Prime Minister stands in for the President of the Republic in the aforementioned situations. type: body-->\n<div id=\"section/310\" class=\"section\">\n<p class=\"content\">The dispositions of the present article may be clarified or supplemented by an organic law.</p>\n</div>\n</div><!--Section: section/311, type: title-->\n<div id=\"section/311\" class=\"section\" data-topics=\"http://www.constituteproject.org/ontology/budget,http://www.constituteproject.org/ontology/balbudgt\">\n<h3>Article 48</h3><!--Section: section/312, type: body-->\n<div Proposed law and amendments originating from Parliament are not receivable when their adoption would lead to either a reduction of public revenues, or the creation or aggravation of a public expense without the release of corresponding state funds.</p>\n</div><!--Section: section/341, type: body-->\n<div id=\"section/341\" class=\"section\">\n<p class=\"content\">Amendments may not be totally unrelated to the text they purport to amend.</p>\n</div><!--Section: section/342, type: body-->\n<div id=\"section/342\" class=\"section\">\n<p class=\"content\">If the Government requests it, the relevant Parliamentary Chamber will decide by a single vote, after a debate, on all or part of the text of the proposed amendments, and will only keep the amendments proposed or accepted by the Government.</p>\n</div>\n</div><!--Section: section/343, type: title-->\n<div id=\"section/343\" class=\"section\">\n<h3>Article 56</h3><!--Section: section/344, type: body-->\n<div id=\"section/344\" class=\"section\">\n<p class=\"content\">If it appears, over the course of the legislative procedure, that a text or an amendment is not within the domain of the law in the sense given by the aforementioned article 47, or if it oversteps the limits of legislative authority accorded to the Government by virtue of article 52, the Prime Minister or the president of the concerned Chamber at the demand of a fifth of its members, may raise the issue of inadmissibility.</p>\n</div><!--Section: section/345, type: body-->\n<div id=\"section/345\" class=\"section\">\n<p class=\"content\">In the case of disagreement, the Constitutional Court will be called. However, at the demand of the government and in case of urgency, this delay will be shortened to eight (8) days. Recourse to the Constitutional Court for a ruling will suspend the usual time period for the promulgation of the law or application of the act.</p>\n</div><!--Section: section/475, type: body-->\n<div id=\"section/475\" class=\"section\">\n<p class=\"content\">Laws or regulatory acts declared unconstitutional may not be promulgated or applied.</p>\n</div>\n</div><!--Section: section/476, type: title-->\n<div id=\"section/476\" class=\"section\" data-topics=\"http://www.constituteproject.org/ontology/uncon\">\n<h3>Article 86</h3><!--Section: section/477, type: body-->\n<div id=\"section/477\" class=\"section\">\n<p class=\"content\">All persons subject to a trial may, at the occasion of a trial before an ordinary tribunal, raise an exception of unconstitutionality against a law or act that abused their fundamental rights.</p>\n</div><!--Section: section/478, type: body-->\n<div id=\"section/478\" class=\"section\">\n<p class=\"content\">The presiding judge may call upon the Constitutional Court by way of a prejudicial exception.</p>\n</div><!--Section: section/479, type: body-->\n<div id=\"section/479\" class=\"section\">\n<p class=\"content\">The Constitutional Court will rule within one (1) month. The necessary funds for the function of its court are inscribed in the laws of finances.</p>\n</div><!--Section: section/515, type: body-->\n<div id=\"section/515\" class=\"section\">\n<p class=\"content\">The rules of organization of function of the Constitutional Court, as well as the procedure it follows, are determined by an organic law.</p>\n</div>\n</div>\n</div><!--Section: section/516, type: title-->\n<div id=\"section/516\" class=\"section\" data-topics=\"http://www.constituteproject.org/ontology/medcom\">\n<h2>TITLE VII. OF THE NATIONAL COUNCIL OF COMMUNICATION</h2><!--Section: section/517, type: title-->\n<div id=\"section/517\" class=\"section\" class=\"content\">Audiovisual and written communication is free in the Gabonese Republic, restricted only by respect of the public order, liberty and dignity of its control of programs and the current regulation of communication materials, as well as the regulations governing their use;</p>\n</div><!--Section: section/527, type: body-->\n<div id=\"section/527\" class=\"section\">\n<p class=\"content\">The respect of the rules governing professionals in the communication field;</p>\n</div><!--Section: section/528, type: body-->\n<div id=\"section/528\" id=\"section/534\" class=\"section\">\n<p class=\"content\">The protection of children and adolescents from certain programming by public and private companies of audiovisual communications;</p>\n</div><!--Section: section/535, type: body-->\n<div id=\"section/535\" class=\"section\" data-topics=\"http://www.constituteproject.org/ontology/cultrght\">\n<p class=\"content\">The defense and illustration of Gabonese culture;</p>\n</div><!--Section: section/536, type: body-->\n<div id=\"section/536\" class=\"section\">\n<p class=\"content\">The respect and dignity of human rights by the organs of information and communication.</p>\n</div>\n</li></ul></div>\n</div><!--Section: section/537, type: title-->\n<div id=\"section/537\" class=\"section\">\n<h3>Article 96</h3><!--Section: section/538, type: body-->\n<div id=\"section/538\" class=\"section\">\n<p class=\"content\">In the event of legal violations, the National Council of Communication may address the concerned parties with public observations and apply the appropriate sanctions.</p>\n</div>\n</div><!--Section: section/539, type: title-->\n<div id=\"section/539\" class=\"section\" data-topics=\"http://www.constituteproject.org/ontology/conpow\">\n<h3>Article 97</h3><!--Section: section/540, type: body-->\n<div id=\"section/540\" class=\"section\">\n<p class=\"content\">All conflicts between the National Council of Communication and another public agency will be decided by the Constitutional Court at the request of one of the involved parties.</p>\n</div>\n</div><!--Section: section/541, type: title-->\n<div id=\"section/541\" class=\"section\">\n<h3>Article 98</h3><!--Section: section/542, type: body-->\n<div id=\"section/542\" class=\"section\">\n<p class=\"content\">The National Council of Communication is composed of nine (9) members nominated as follows:</p><!--Section: section/543, type: list-->\n<ul><li id=\"section/543\" style=\"list-style-type: ' '\">\n<p class=\"content\">Three by the President of the Republic, of which one will be the president of the Council;</p><!--Section: section/545, type: class=\"section\">\n<p class=\"content\">Each of the authorities mentioned above will also nominate two communication specialists for the Council.</p>\n</div>\n</div><!--Section: section/548, type: title-->\n<div id=\"section/548\" class=\"section\" data-topics=\"http://www.constituteproject.org/ontology/artists,http://www.constituteproject.org/ontology/science\">\n<h3>Article 99</h3><!--Section: section/549, type: body-->\n<div id=\"section/549\" class=\"section\">\n<p class=\"content\">The members of the National Council of Communication must have credentials or skills in communication, public administration, the sciences, law, culture or the arts, a professional career of at least fifteen (15) years and be at least forty (40) years old.</p>\n</div>\n</div><!--Section: section/550, type: title-->\n<div id=\"section/550\" class=\"section\">\n<h3>Article 100</h3><!--Section: section/551, type: body-->\n<div id=\"section/551\" class=\"section\">\n<p class=\"content\">The members of the National Council of Communication have a term of five (5) years, which can be renewed. At the moment of renewal, a least a third (1/3) of the members must be replaced with new nominations.</p>\n</div><!--Section: section/552, type: body-->\n<div id=\"section/552\" class=\"section\">\n<p class=\"content\">In case of a member\u2019s death or resignation, the nominating authority over that seat will appoint a new member to finish the term.</p>\n</div>\n</div><!--Section: section/553, type: title-->\n<div id=\"section/553\" class=\"section\">\n<h3>Article 101</h3><!--Section: section/554, type: body-->\n<div id=\"section/554\" class=\"section\">\n<p class=\"content\">The president of the National Council of Communication will maintain his or her position for the duration of his or her term.</p>\n</div><!--Section: section/555, type: body-->\n<div id=\"section/555\" class=\"section\">\n<p class=\"content\">The president is assisted by a vice-president, nominated within the same conditions and for the same length of term.</p>\n</div><!--Section: section/556, type: body-->\n<div id=\"section/556\" class=\"section\">\n<p class=\"content\">In case of a temporary vacancy, the vice-president will fill the president\u2019s seat.</p>\n</div>\n</div><!--Section: section/557, type: title-->\n<div id=\"section/557\" class=\"section\">\n<h3>Article 102</h3><!--Section: section/558, type: body-->\n<div id=\"section/558\" class=\"section\">\n<p class=\"content\">An organic law fixes the organization and function of the National Council of Communication, as well at the regulations regarding incompatible concurrent positions or responsibilities.</p>\n</div>\n</div>\n</div><!--Section: section/559, type: title-->\n<div id=\"section/559\" class=\"section\">\n<h2>TITLE VIII. OF THE ECONOMIC AND SOCIAL COUNCIL</h2><!--Section: section/560, type: title-->\n<div id=\"section/560\" class=\"section\">\n<h3>Article 103</h3><!--Section: section/561, type: body-->\n<div id=\"section/561\" class=\"section\">\n<p class=\"content\">The Social and Economic Council, governed by the dispositions of articles 8 paragraph 3, 28 paragraph 1, and article 53 above, has authority over all the aspects for economic, social and cultural development:</p><!--Section: section/562, type: list-->\n<ul><li id=\"section/562\" style=\"list-style-type: ' '\">\n<p class=\"content\">The general direction of the country\u2019s economy;</p><!--Section: section/564, type: body-->\n<div id=\"section/564\" class=\"section\">\n<p class=\"content\">Financial and budgetary policies;</p>\n</div><!--Section: section/565, type: body-->\n<div id=\"section/565\" class=\"section\">\n<p class=\"content\">Policies governing natural resources;</p>\n</div><!--Section: section/566, type: body-->\n<div id=\"section/566\" class=\"section\">\n<p class=\"content\">Social and cultural policies;</p>\n</div><!--Section: section/567, type: body-->\n<div id=\"section/567\" class=\"section\" data-topics=\"http://www.constituteproject.org/ontology/env\">\n<p class=\"content\">Environmental policies.</p>\n</div>\n</li></ul></div>\n</div><!--Section: section/568, type: title-->\n<div id=\"section/568\" class=\"section\">\n<h3>Article 104</h3><!--Section: section/569, type: body-->\n<div id=\"section/569\" class=\"section\">\n<p class=\"content\">The Economic and Social Council participates in all commissions of national interest with an economic and social character.</p>\n</div><!--Section: section/570, type: body-->\n<div id=\"section/570\" class=\"section\">\n<p class=\"content\">With the participation of its different composite entities, it assembles and drafts an annual collection of goals, needs and issues of the civil society with relevant propositions addressed to the attention of the President of the Republic, the Government and Parliament.</p>\n</div>\n</div><!--Section: section/571, type: title-->\n<div id=\"section/571\" class=\"section\">\n<h3>Article 105</h3><!--Section: section/572, type: body-->\n<div id=\"section/572\" class=\"section\">\n<p class=\"content\">The Economic and Social Council is charged with giving its opinion on economic, social and cultural questions presented for its review by the President of the Republic, the Government, Parliament or another public institution.</p>\n</div><!--Section: section/573, type: body-->\n<div id=\"section/573\" class=\"section\">\n<p class=\"content\">It is obligatorily consulted on all economic, social and cultural planning and programming projects, as well as all legislative operations with a fiscal, economic, social or cultural character. It may participate in a project\u2019s preliminary drafting.</p>\n</div><!--Section: section/574, type: body-->\n<div id=\"section/574\" class=\"section\">\n<p class=\"content\">The Prime Minister, in the name of the Government, may call upon the Economic and Social Council for opinions or studies.</p>\n</div>\n</div><!--Section: section/575, type: title-->\n<div id=\"section/575\" class=\"section\">\n<h3>Article 106</h3><!--Section: section/576, type: body-->\n<div id=\"section/576\" class=\"section\">\n<p class=\"content\">The Economic and Social Council may also proceed to analyze current issues in economic and social development. It submits its findings to the President of the Republic, the Government and Presidents of the Chambers of Parliament.</p>\n</div>\n</div><!--Section: section/577, type: title-->\n<div id=\"section/577\" class=\"section\">\n<h3>Article 107</h3><!--Section: section/578, type: body-->\n<div id=\"section/578\" class=\"section\">\n<p class=\"content\">The Economic and Social Council may nominate one of its members, at the request of the President of the Republic, the Government and the presidents of the Chambers of Parliament, to expose before these institutions the Council\u2019s opinion on the projects or positions of law it receives.</p>\n</div><!--Section: section/579, type: body-->\n<div id=\"section/579\" class=\"section\">\n<p class=\"content\">The Government and Parliament are obligated, when they are called upon, to give a response to the opinions and reports formulated by the Economic and Social Council within a maximum delay of three (3) months for the Government, and before the end of their current session for Parliament.</p>\n</div><!--Section: section/580, type: body-->\n<div id=\"section/580\" class=\"section\">\n<p class=\"content\">The Economic and Social Council receives a certified copy of all laws, ordinances and decrees at the moment of their promulgation. It ensures the execution of the Government\u2019s decisions related to the economic and social organization of the country.</p>\n</div>\n</div><!--Section: section/581, type: title-->\n<div id=\"section/581\" class=\"section\">\n<h3>Article 108</h3><!--Section: section/582, type: body-->\n<div id=\"section/582\" class=\"section\">\n<p class=\"content\">The Economic and Social Council rightly convenes each year in two ordinary sessions of fifteen (15) days each. The first session begins on the third Tuesday of February and the second session begins on the first Tuesday of September.</p>\n</div><!--Section: section/583, type: body-->\n<div id=\"section/583\" class=\"section\">\n<p class=\"content\">The opening of each session is postponed to the next day if the original day provisioned is not possible.</p>\n</div><!--Section: section/584, type: body-->\n<div id=\"section/584\" class=\"section\">\n<p class=\"content\">If, outside of ordinary sessions, the Council is called upon for a drafting of a law of finances, the Council may convene in an extraordinary session for ten (10) additional days.</p>\n</div><!--Section: section/585, type: body-->\n<div id=\"section/585\" class=\"section\">\n<p class=\"content\">The sessions of the Economic and Social Council are public.</p>\n</div>\n</div><!--Section: section/586, type: title-->\n<div id=\"section/586\" class=\"section\">\n<h3>Article 109</h3><!--Section: section/587, type: body-->\n<div id=\"section/587\" class=\"section\">\n<p class=\"content\">The members of the Economic and Social Council are:</p><!--Section: section/588, type: list-->\n<ul><li id=\"section/588\" style=\"list-style-type: ' '\">\n<p class=\"content\">The representatives of trade unions, socio-professional associations, and groups elected by their group or association;</p><!--Section: section/590, type: body-->\n<div id=\"section/590\" class=\"section\">\n<p class=\"content\">Superior executives of the state in the social and economic domains;</p>\n</div><!--Section: section/591, type: body-->\n<div id=\"section/591\" class=\"section\">\n<p class=\"content\">The representatives of local collectivities nominated by their peers.</p>\n</div>\n</li></ul></div><!--Section: section/592, type: body-->\n<div id=\"section/592\" class=\"section\">\n<p class=\"content\">In the case of the death or resignation of a Council member, or the loss of his or her profession in the sector of origin, the new member nominated to the vacant seat will continue and finish the already begun mandate.</p>\n</div>\n</div><!--Section: section/593, type: title-->\n<div id=\"section/593\" class=\"section\">\n<h3>Article 110</h3><!--Section: section/594, type: body-->\n<div id=\"section/594\" class=\"section\">\n<p class=\"content\">The president of the Economic and Social Council is nominated by the decree of the President of the Republic from among the superior executives of the state nominated to the Council.</p>\n</div><!--Section: section/595, type: body-->\n<div id=\"section/595\" class=\"section\">\n<p class=\"content\">The two vice-presidents and other members of the Bureau are nominated by the President\u2019s decree from the proposal of union representatives and socio-professional associations or groups.</p>\n</div><!--Section: section/596, type: body-->\n<div id=\"section/596\" class=\"section\">\n<p class=\"content\">The members of the Council\u2019s Bureau hold their nominated positions for the entirety of their mandate.</p>\n</div><!--Section: section/597, type: body-->\n<div id=\"section/597\" class=\"section\">\n<p class=\"content\">No member of the Economic and Social Council may be pursued, investigated or judged for opinions expressed during the Council\u2019s sessions.</p>\n</div>\n</div><!--Section: section/598, type: title-->\n<div id=\"section/598\" class=\"section\">\n<h3>Article 111</h3><!--Section: section/599, type: body-->\n<div id=\"section/599\" class=\"section\">\n<p class=\"content\">An organic law fixes the internal organization, rules of operation and nomination of the members of the Economic and Social Council.</p>\n</div>\n</div>\n</div><!--Section: section/600, type: title-->\n<div id=\"section/600\" class=\"section\" data-topics=\"http://www.constituteproject.org/ontology/mun\">\n<h2>TITLE IX. OF THE LOCAL COLLECTIVITIES</h2><!--Section: section/601, type: title-->\n<div id=\"section/601\" class=\"section\">\n<h3>Article 112</h3><!--Section: section/602, type: body-->\n<div id=\"section/602\" class=\"section\">\n<p class=\"content\">The local collectivities of the Republic are created by law. They cannot be modified or eliminated without the opinions of the relevant Councils and within the conditions fixed by the law.</p>\n</div><!--Section: section/603, type: body-->\n<div id=\"section/603\" class=\"section\">\n<p class=\"content\">The collectives administer themselves freely by the elected Councils and within the conditions provisioned by the law, notably those that concern their authority and resources.</p>\n</div>\n</div><!--Section: section/604, type: title-->\n<div id=\"section/604\" class=\"section\">\n<h3>Article 112a</h3><!--Section: section/605, type: body-->\n<div id=\"section/605\" class=\"section\">\n<p class=\"content\">Local consultations, addressing specific problems not applicable to the law, may be organized at the initiative of either the elected Councils or interested citizens according to the conditions fixed by the law.</p>\n</div>\n</div><!--Section: section/606, type: title-->\n<div id=\"section/606\" class=\"section\">\n<h3>Article 112b</h3><!--Section: section/607, type: body-->\n<div id=\"section/607\" class=\"section\">\n<p class=\"content\">The conflicts of authority between local collectivities or a local collectivity and the State are taken before administrative jurisdictions at the request of the responsible authorities or the representative of the State.</p>\n</div><!--Section: section/608, type: body-->\n<div id=\"section/608\" class=\"section\">\n<p class=\"content\">The representative of the State ensures the respect of national interests.</p>\n</div><!--Section: section/609, type: body-->\n<div id=\"section/609\" class=\"section\">\n<p class=\"content\">An organic law specifies the manner in which the present title may be applied.</p>\n</div>\n</div>\n</div><!--Section: section/610, type: title-->\n<div id=\"section/610\" class=\"section\" data-topics=\"http://www.constituteproject.org/ontology/intlaw\">\n<h2>TITLE X. OF THE REVISION OF THE CONSTITUTION</h2><!--Section: section/622, type: title-->\n<div id=\"section/622\" class=\"section\" data-topics=\"http://www.constituteproject.org/ontology/referen\">\n<h3>Article 116</h3><!--Section: section/623, type: body-->\n<div id=\"section/623\" class=\"section\">\n<p class=\"content\">The initiative to revise the Constitution concurrently belongs to the President of the Republic, the collective Council of Ministers and members of Parliament.</p>\n</div><!--Section: section/624, type: body-->\n<div id=\"section/624\" class=\"section\">\n<p class=\"content\">All propositions of revision may be submitted to the Bureau of the National Assembly by at least a third of Deputies, or to the Bureau of the Senate by at least a third of the Senators.</p>\n</div><!--Section: section/625, type: body-->\n<div id=\"section/625\" class=\"section\">\n<p class=\"content\">All projects or propositions of revision to the Constitution, as well as all amendments to the document must be submitted, for consultation, to the Constitutional Court before the referendum or the reunion of Parliament.</p>\n</div><!--Section: section/626, type: body-->\n<div id=\"section/626\" class=\"section\">\n<p class=\"content\">The revision may be accepted either by a referendum vote or by a parliamentary vote.</p>\n</div><!--Section: section/627, type: body-->\n<div id=\"section/627\" class=\"section\">\n<p class=\"content\">In the first case, the proposed revision will be submitted to a referendum by the President of the Republic, conforming to the dispositions of article 18 above.</p>\n</div><!--Section: section/628, type: body-->\n<div id=\"section/628\" class=\"section\">\n<p class=\"content\">In the second case, the National Assembly and the Senate respectively must vote upon the proposed revision without any modification before it is submitted to a convened Parliament.</p>\n</div><!--Section: section/629, type: body-->\n<div id=\"section/629\" class=\"section\" data-topics=\"http://www.constituteproject.org/ontology/legjoint\">\n<p class=\"content\">The adoption of any proposed revisions of the Constitution by a Parliamentary vote requires at least a two-thirds vote from the members of the two reunited Chambers. The President of the National Assembly assures the leadership of the congress.
